Las Aguas Post Tracker Terms of Service

1. Overview

These Terms of Service (“Terms”) govern your use of the applications operated by Las Aguas Productions UG (haftungsbeschränkt) (“Las Aguas”, “we”, “us”, or “our”) that power the Las Aguas Artist Dashboard available at https://lasaguasproductions.com/dashboard, together with the Las Aguas Indie platform (collectively, the “Services”). The applications covered by these Terms include:

• Las Aguas Post Tracker — our application registered with TikTok for Developers, which connects to your TikTok account through TikTok Login Kit and the TikTok Content Posting API.
• LA Dashboard Posts Tracker — our application registered with Meta for Developers, which connects to your Instagram Professional account or Facebook Page through Meta Login and the Meta Graph API.

Together with our integrations with YouTube and Spotify, these applications (each an “App” and collectively the “Apps”) make up the Las Aguas Artist Dashboard. The Apps are private tools for verified clients of Las Aguas and are not public platforms. By accessing or using any of the Apps, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Apps.

2. Access and Accounts

• Access to the Apps is exclusive to subscribers of Las Aguas and authorised team members.
• You must provide accurate information and keep your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• You may not share your account or attempt to access another user's account or data.

3. Connected Social Accounts

By connecting a third-party account to the Las Aguas Artist Dashboard, you authorise the relevant App to retrieve data from that account, and where applicable to upload or publish content on your behalf, through the platform’s official API and only for the scopes you grant during connection. Each platform connection is handled by the App registered with that platform:

• TikTok connections are handled by Las Aguas Post Tracker through TikTok Login Kit and the TikTok Content Posting API.
• Instagram Professional and Facebook Page connections are handled by LA Dashboard Posts Tracker through Meta Login and the Meta Graph API.
• YouTube connections are handled through Google OAuth and the YouTube Data API.
• Spotify connections are handled through the Spotify for Artists API.

Your use of each connected platform remains governed by that platform’s own terms and community guidelines, including the TikTok Terms of Service, the Meta Terms of Service, the YouTube Terms of Service, and the Spotify Terms of Use, and you remain responsible for complying with them.

The exact scopes each App uses on each platform — including, on TikTok, the video.upload and video.publish scopes that allow Las Aguas Post Tracker to upload drafts to your account or publish a video to your TikTok profile when you trigger a publish action inside the dashboard — are described in our Privacy Policy. The Apps will not read direct messages, private communications, or comment content from connected accounts; will not auto-post without an explicit action you take in the dashboard; and will not collect data from accounts that you have not explicitly connected.

You may disconnect any platform at any time from the dashboard’s Settings page or from the platform’s own security settings (for example, the “Apps and websites” section of your TikTok, Instagram, Facebook, Google, or Spotify account). Disconnecting revokes the relevant App’s access tokens immediately and stops further API calls.

4. Acceptable Use

You agree that you will not:

• Use the Apps in violation of any applicable law or third-party platform terms
• Upload content you do not have the rights to use
• Attempt to reverse engineer, scrape, or interfere with the Apps or their underlying APIs
• Use the Apps to harass, defame, or impersonate any person
• Use the Apps to circumvent rate limits, audience-restriction features, or any platform's security controls

5. App Usage Data

We collect data about how you use the Apps (pages visited, features used, frequency of use). This is used solely to improve the Apps and operate the Services and will not be shared in any individually identifiable form outside Las Aguas.

6. Data Sharing

Your data will not be shared in non-anonymised form with anyone outside Las Aguas, or with any other users of the Apps, without your express written permission. This applies to your social analytics, uploaded content, account details, and usage data, and is described in more detail in our Privacy Policy.

7. Uploaded Content

You retain ownership of all content you upload to the Apps. By uploading, you confirm you hold all necessary rights to that content. You grant Las Aguas a limited, non-exclusive, royalty-free licence to store, process, transmit, and display your content solely to provide the Services to you.

8. Analytics Disclaimer

Analytics and metrics shown in the Apps are sourced from third-party platform APIs (TikTok via Las Aguas Post Tracker, Meta via LA Dashboard Posts Tracker, YouTube, and Spotify). Las Aguas does not guarantee their completeness, real-time accuracy, or continuous availability. Platform outages, scope changes, and API changes are outside our control.

9. Service Changes

We may modify, suspend, or discontinue any part of the Apps at any time. We will provide reasonable notice where practical.

10. Intellectual Property

You retain ownership of your content. Las Aguas retains all rights to the Apps and the Services, including the software, design, and Las Aguas branding. You may not copy, modify, or distribute any part of the Apps.

11. Termination

Las Aguas may suspend or terminate your access to the Apps if your client relationship or subscription ends, if you breach these Terms, or if we detect misuse or security risks. You may stop using the Apps at any time and may request deletion of your data as described in our Privacy Policy. Upon termination, your access will cease and we may retain certain records consistent with the Privacy Policy.

12. Disclaimers and Limitation of Liability

The Apps and the Services are provided “as is” without warranties of any kind. To the fullest extent permitted by law, Las Aguas will not be liable for any indirect, incidental, or consequential damages arising from your use of the Apps.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-laws principles, except where mandatory consumer protection law of your country of residence requires otherwise. Exclusive venue is Berlin, Germany, where permitted by law.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you in the dashboard. Continued use of the Apps after an update constitutes acceptance of the revised Terms.
